Terms and Conditions

1. MF Group/POWERPAY  checkout notice

You will receive the single invoice free of charge by email. With purchase on invoice you accept the GTC  from POWERPAY (powerpay.ch/en/agb), provided you have a valid email address.

2. Description of the service

Smartmobile.ch is an internet shop and deals in mobile phone, tablet and notebook accessories.

3. Terms of Delivery and Sale

Smartmobile.ch supplies Switzerland and Liechtenstein. In Switzerland and Liechtenstein, delivery usually takes place within 1 to 2 working days after receipt of payment. All items in our shop can be delivered, however, incorrect entries by our employees are excluded - sold-out products are removed from the shop range or are accordingly clearly marked.

4. Order 24/7

You place an online order in the shop. The order is binding once you have pressed the submit button. Please note that a legally valid purchase contract is created. After we have received your order, you will automatically receive a copy of your order by e-mail.

5. Prices

Our sales prices are shown in CHF and are subject to change. All prices include shipping costs. We reserve the right to make price corrections and changes to our terms of delivery and payment.

6. Payment

We currently offer the following payment options: Visa and Mastercard, PayPal, PostFinance Card, PostFinance e-finance and prepayment. If you pay in advance, you will receive an e-mail with the account details for the transfer after placing your order. The order by prepayment is to be paid after 7 days at the latest. As soon as we have the money in our account, the goods will be shipped. With the PayPal payment you get directly after the order on the PayPal homepage for the transfer. You can easily place an order without having a PayPal account, all you need is a credit card. At PostFinance you get to the PostFinance homepage and can process your payment there with the PostFinance card or PostFinance login data. Transmissions of your card details are fully SSL secured!

7. Return Policy

A return is possible if this is communicated within 7 days by email ([email protected]). When returning the item, you can choose between an exchange and a refund. The prerequisite for a return is that the item(s) are returned without any defects and unused.

Return if the accessory arrives damaged: In this case, we ask you to send us an e-mail ([email protected]) including a photo of the damage within 7 days, and we will then decide how to proceed by e-mail.

8. Right of Withdrawal and Defects

Complaints about scope of delivery, material defects, incorrect deliveries and quantity discrepancies must be made in writing immediately, but no later than one week after receipt of the goods, insofar as these can be determined by reasonable examinations. The goods can only be exchanged or taken back if the notice of defects is justified.

9. Our offers

Our online offer is subject to change and non-binding. Changes in color, appearance, quality and price are subject to change. We reserve the right to make technical changes to articles, misprints, prices, mistakes and delivery options. We accept no liability for any damage or subsequent damage that may occur during the operation or use of our products, since we cannot control and monitor proper use.

10. Changes to the Terms and Conditions

We reserve the right to change the terms and conditions at any time. The terms and conditions as published in the web shop apply.

11. Final Provisions

Swiss law applies to the exclusion of the UN Convention on the International Sale of Goods. The place of performance for all claims arising from the contracts concluded with us is our place of business. The exclusive place of jurisdiction for all mutual claims arising from or in connection with the business relationship is Zürich (CH). In addition, we can, at our discretion, sue the customer at his registered office. The effectiveness of individual provisions of these conditions has no influence on the validity of the remaining provisions and the existence of the contract. The ineffective provision is replaced by a provision that comes as close as possible to the ineffective provision in terms of its economic content. The same applies in the case of a gap.

12. Payment on account:

When paying by invoice, the invoice must be paid within 10 days. Smart Mobile GmbH reserves the right to obtain credit checks on the customer and is entitled to forward customer data to third parties. In the event of a delay in payment, default interest of 5% per year and reminder fees of CHF 10 for the first reminder and CHF 15 for the second reminder will be charged. In the event of a delay in payment, SMARTMOBILE GmbH is entitled to assign the claim to a third party or to commission the collection with costs for the customer.
